Marcus Rashford scored his fourth league goal of the season

Aston Villa have been relegated to English football's second tier for the first time since 1987 after defeat at Manchester United.
Marcus Rashford scored the only goal, sweeping Antonio Valencia's cut-back through goalkeeper Brad Guzan's legs.
Villa were second best for much of the game, though they did hit a post late on through Rudy Gestede's volley.
It was a ninth straight loss for the visitors and left them 15 points from safety with only four matches left.

Jonas Gutierrez wins Newcastle United discrimination tribunal case

Jonas Gutierrez
Jonas Gutierrez left Newcastle United in May 2015 after seven years at St James' Park

Midfielder Jonas Gutierrez was dropped by Newcastle United because of his cancer diagnosis, an employment tribunal has found.
The 32-year-old was suing the Magpies for about £2m on the grounds of disability discrimination.
The tribunal also ruled the club made it impossible for Gutierrez to trigger an appearance-based contract extension.
Newcastle say they are "dismayed" by the judgement and are considering further options with their legal team.
Gutierrez's barrister Martin Budworth said: "The tribunal has made it clear that a Premier League football club owes the same duties to a disabled person as any other employer."
Claims of unfavourable treatment and another of harassment related to disability were dismissed.
A further remedy hearing will be held in due course, in which compensation will be addressed.
Although Gutierrez has not released a statement, he did post on social media, saying: "Always in my heart Geordie nation. I love you."

Gutierrez's claims

Gutierrez, who joined Newcastle from Real Mallorca in 2008, was diagnosed with testicular cancer in October 2013.
He had been a regular at St James' Park before that time, scoring 10 goals in 177 appearances at the time of the return of the illness and subsequent treatment.
The Argentina international sued Newcastle over the way he was treated following his diagnosis and claimed the Premier League club saw him as a liability after he returned from treatment.
Gutierrez, now playing for Deportivo La Coruna in Spain, also alleged that he was not selected for some of the second half of the 2014-15 season, when the Magpies avoided relegation on the final day of the campaign, so the club would not trigger an automatic one-year contract extension.

The findings

The tribunal found that Gutierrez was discriminated against following his diagnosis and subsequent return to fitness as it deemed he was considered part of the club's plans right up to the point of his absence.
The ruling stated:
  • Gutierrez "had maintained his place in the starting line-up without difficulty for five years."
  • "Just over two weeks after the claimant returned to the club in November 2013 following his diagnosis and treatment, and at a point when he was match fit and returning to action he was told that he no longer featured in the club's future plans. We conclude that the decision to drop the claimant was because of the claimant's cancer."
The tribunal also concluded that Gutierrez was not considered for selection following his return to fitness until he could not achieve the 80 Premier League starts required over the length of his four-year contract to trigger the extension.
As a result of his absence because of cancer, Gutierrez had only 121 games instead of 152 to earn his extended deal and the club had discriminated against him by failing to make reasonable adjustments.
The ruling stated:
  • "It was in essence more difficult for the claimant to achieve the required number of games because in the periods of time that he was not absent for treatment or rehabilitation he had to be more frequently selected as a proportion of the total number of games available than his non disabled counterparts. We conclude that this was a substantial (more than minor or trivial) disadvantage."
  • "Had the possibility of a triggering of the clause not been an issue then Mr Charnley [Newcastle managing director Lee] would not have needed to discuss it at all with Mr Carver [former manager John] and would not have needed to double check how close the claimant was to triggering the clause."
Claims of unfavourable treatment were rejected, as his move to Norwich City on loan in January 2014 was consensual.
A claim of harassment which related to Gutierrez training and playing with the under-21s was also dismissed as the tribunal ruled that many players, such as "Davide Santon, Siem de Jong and Gabriel Obertan" were required to do so to gain match fitness after injury.

The witnesses

Parts of John Carver's evidence were "vague" and "rejected"
John Carver

  • Gutierrez was found to be a "credible and convincing witness".
  • Former Newcastle boss Alan Pardew "was able to deliver his evidence in a confident, convincing and articulate way".
  • However, "the detail of what was said was not necessarily as credible as the manner in which the evidence was delivered". Some of Pardew's evidence was deemed to be contradictory and "inconsistent".
  • Managing director Charnley's evidence was described as "evasive and lacking in credibility".
  • Parts of former Newcastle boss John Carver's evidence were "vague" and were "rejected".

Newcastle's unconvincing evidence

  • In August 2013, Newcastle's doctor club advised that Gutierrez, who was recovering from a hamstring injury, should be picked as a substitute "at the very most".
  • Pardew had picked Gutierrez to play and told the hearing that he "did not understand" the doctor's advice, a claim the tribunal considered "improbable".
  • Pardew was dismissive of the doctor's notes in Gutierrez's medical record, which read: "Somehow managed to start game against Manchester City. Manager's decision, against medical advice."
  • Charnley would not accept that Gutierrez was an established international player, despite winning 22 caps and playing at the 2010 World Cup for Argentina.
  • Charnley "could not say" how many international players Newcastle had in their squad in September 2011.
  • Charnley said that Gutierrez's 71 starts in 76 games in 2011-12 and 2012-13 only "demonstrated someone who plays for the first team" and not consistent performance.
  • Carver told the tribunal that Gutierrez "had a certain clause in his contract if he reached a certain criteria".
  • He later said there was no discussion about the clause and denied knowing what the "certain criteria" might be.

IS NIGERIA INDEPENDENT OR WAS IT JUST A MERE VERBAL AGREEMENT WITH THE BRITISH COLONIAL MASTERS??

Hello readers, it’s quite unfortunate that my previous post in relation with this one sparked a lot of controversy, but do I look like I care?. One reader from china sent me a mail with all sorts of vague words and she summarized it with  “ **explicit** controversial blogger”  I simply replied “thanks I’ll make that my blog’s subtitle”.
On the contrary, many people applauded the post but if I start revealing comments one after the other you might get stuck in reading the preface without going through the content.  The title remains but with a subtitle I termed “ is Nigeria independent or was it just a verbal agreement with the british colonial masters?:::: I’ve tried but couldn’t fathom the direction our dear nation Nigeria is headed. A man once said that this country is like the titanic ship that very soon it’ll hit an iceberg, he said this like a decade ago, and me with little or experience in life back then replied mildly “God forbid” but now I understand what he meant by that, cos if you recall the titanic movie, that part the ship met the iceberg wasn’t funny at all. Another notable man in Nigeria Hon Patrick Obaghiagbon said in an interview with sunrise T.V that the ship of the nation is hovering round the political Bermuda triangle”, you may tag this man a person with sophisticated grammars that has no meaning but he was my favourite in the house of Rep. Nigeria today is still hanging in the balance, like I said, am yet to fathom her direction, it’s over fifty years of independence but we’re still in the scratch.  Every new leader elected or selected (whichever way) tells same stale story the previous one told and at the end we see little or no result.
We are independent but we take orders like we’re still in the colonial years.   Nigeria last time i checked was seventh in  forbes world most populated country but we have nothing (in terms of economic balance) to show for it.   Anybody given a little position will like to exploit it, they don’t care about the masses once their pockets are filled, their children attending the best institutions In the world.  Tell me why foreigners won’t alienate us in our own country? Since our leaders turned their backs on us after pocketing a significant amount of hard currencies given to them as bribe by the aliens (foreigners), the so-called aliens will do as they wish even those from hunger-stricken country now become lords in Nigeria.

Like I said in my previous post, foreigners don’t even need our opinion in their company, they do their meetings all by themselves then pass sickening and unchallengeable orders to us. The worst of it all is that most of them (aliens) don’t even have a permit to live and work here, when the representatives of the agency  in charge visits them, they bribe them with cash and some of their products, now tell me how they’ll value us? , they’ll say to themselves “they are bunch of hungry corrupt fools just give them N2000 they’ll go” and it works for them!!!. isn't that shameful??.
Please this is a wake up call for everybody concerned cos i know the well being of this country is for our own betterment and also for generations to come.  Let's join hands if possible heads and make Nigeria a better place to stay cos God already blessed us with war-free zone, no natural phenomena and a greenish part of the planet, so the fate of the nation is in our hands, let's handle it with care cos it's fragile.
NOTE:: am not a homophobist, just trying to straighten things up!!!. but life's all about choice , you are bound to believe whatever you want to believe, it's your right but as for me IDGAF
GOD BLESS NIGERIA

Adam Johnson lodges appeal over six-year jail term

Adam Johnson
The sexual activity with the girl happened in January 2015 after Johnson had groomed her using social media apps

Footballer Adam Johnson has formally lodged an appeal against his six-year sentence for grooming and sexual activity with a girl aged 15.
The former Sunderland and England player was jailed last month following a trial at Bradford Crown Court.
An official at the court confirmed that Johnson's legal team had lodged an appeal against his sentence.
The 28-year-old has already begun an appeal against his conviction of sexual activity with a 15-year-old.
Johnson admitted grooming the girl and a separate, less serious charge, of sexual activity.
On the Adam Johnson's Appeal Fight Facebook page, run by his sister Faye, a post said: "Adam's appeal against his sentence has now been lodged!"
It added: "Thanks everyone for your support it means a lot! X"
Sentencing the player, Judge Jonathan Rose told him he had abused a position of trust and caused his victim "severe psychological harm".
Johnson began his career at Middlesbrough before moving to Manchester City and then on to Sunderland in 2012.

Conte hoping to reunite with midfielder at Chelsea

The Blues could offer up to €40 million to convince Bayern Munich to part with Arturo Vidal in the summerArturo Vidal
As Antonio Conte’s future with Chelsea waits on the horizon, the Italy coach is looking to bring former Juventus maestro Arturo Vidal to the Premier League.
The Chilean continues to shine at Bayern Munich this season with four goals and eight assists in all competitions, but the chance to reunite with the Italian tactician could push the Blues to make a large offer this summer.
“In war, I would always want someone like Arturo beside me,” the Azzurri boss said in reference to his times with the midfielder.

Vidal showed that the feeling was mutual when doing battle against Juve in the Champions League last month: “And I’m the same, with Conte I would feel comfortable even in the worst situations.”
Such a positive relationship between the player and coach reveals that their resounding successes in Turin was no coincidence, as Vidal’s versatility in Conte’s tactics helped elevate his status to a top class talent.

In all areas of midfield the Chilean showed a true eye for goal. Seven goals in his first season progressed to 15 in the 2012/13 campaign, and Vidal showed his best form in Conte’s final coaching campaign with the Old Lady by notching 18 goals in the 2013/14 season.
If the right cards fall into place, Conte and Vidal would surely relish the chance to try and conquer England together.

Man Utd could miss out on Zlatan Ibrahimovic if they keep Louis van Gaal

Manchester United could ruin their hopes of landing Zlatan Ibrahimovic by keeping Louis van Gaal as manager for next season and passing up the chance to appoint Jose Mourinho.
Ibrahimovic is yet to agree a new contract at Paris Saint-Germain and would consider a switch to Old Trafford this summer if Mourinho is in charge as the pair are close.

Louis van Gaal
Louis van Gaal and Zlatan Ibrahimovic fell out while they were at Ajax
But the same cannot be said of 34-year-old Ibrahimovic and Van Gaal, as the Swede still harbours a grudge for their fall-out at Ajax - even though it was over 10 years ago.
Ibrahimovic, who scored and missed a penalty against Manchester City in the Champions League on Wednesday night, played at Ajax while Van Gaal was sporting director and the Dutchman resigned soon after selling the striker to Juventus in 2004.

Joe Hart

In his book, I Am Zlatan, Ibrahimovic described Van Gaal as “a pompous ass” and last year added: “The way he is working is not the way I work.”
With United one of the clubs now interested in signing Ibrahimovic if he does not sign a new deal at PSG, a friend of the player has claimed he would “not walk through the door” if Van Gaal stays at Old Trafford.
Ibrahimovic, on the other hand, has made no secret of the fact he would jump at the chance of working with Mourinho again following a short spell under the former Chelsea manager at Inter Milan.

Although Ibrahimovic moved to Barcelona while Mourinho was in charge at Inter, the pair still hold an extremely high opinion of each other and communicate regularly over text message.
On the future of his client, the agent of Ibrahimovic, Mino Raiola, this week said: “Zlatan’s sole priority at this moment is to end the season well.

Zlatan
Zlatan will leave PSG at the end of the season
“Zlatan knows what he wants to do. He wants to play in the final of the Champions League, and if possible to win it.
“Zlatan is motivated and all clubs who offer him a contract know that. He doesn’t need to continue for financial reasons, he wants to prove himself at the highest level, just as he has the other years when people thought he was too old.

Zlatan
Many clubs are interested in signing Zlatan
“I’m not saying the financial aspect is not important at all, but his motivation is not money. If you are the best, you must be paid as the best.”
